Time To Buy A Car

After having been without a car for the greater part of this past year I’m overdo for some change. I do enjoy the benefits of renting from a friend, but c’mon! I need my own car now. But there’s a problem. I’ve learned a thing or two, and it’d be very hard for me to buy a car and register it as usual in good conscience. That said doing the alternative is even harder. So in the spirit of forward movement let’s make a plan.

Points Of Concern

  1. Removing car from the state registry.
  2. Accessing MSO, COV
  3. Insurance While I intend to keep plenty of cash in the bank for this purpose, I really have a need for liability coverage in those rare events.
  4. AAA Registration I’m guessing I need driver’s license, registration, and maybe SSN.
  5. Speed I need to take the shortest route to a safe driveable car as possible.
  6. License Plate Some kind of placeholder. Won’t attract attention, but is clearly not a “forgery” of anything state owned.

License Plate

Black back with white lettering. That wouldn’t be bad, the biggest thing is what do I put on the tag?

Insurance & Liability

For someone of means this is very straight-forward. By being the sole owner of a car, and my own person I take full responsibility and liability for any injuries I cause. Using Common Law Procedure I would work with the injured party to come to an agreement of injuries caused and compensation required. But there is a chance that the injuries are serious enough to be valued above $10k in damages. That’s the type of money that would bankrupt me.

My ideal insurance would be 50 dollars a month, to cover liability up to 250k and personal damages from 2k to 10k. Without a driver’s license, Social Security Number, or vehicle registration.

Places to call: State Farm, Geico, Progressive, Allstate, Liberty Mutual, Farmers, Nationwide, Travelers, American Family, Auto Club Exchange (AAA), Erie Insurance, CSAA Insurance Exchange, National General, Metlife, Country Financial, Sentry, Plymouth Rock

It is a matter of contract law (in theory) therefore I ought to be able to come up with a unique contract.

Or I can get another type of property insurance. Art insurance, Equipment Insurance.

Custom Contract

Before I get too trigger happy and meet with an agent I need to understand the gist of what I want and what the market is offering.

  1. Esurance $52 for liability and personal medical. $39 bare min, liability.
  2. Progressive $51 nearly identical, for maybe a shade less coverage. (requested SSN for credit check)
  3. Liberty Mutal $48, looks identical to Esurance

So that’s my starting point, not much more to say before I give these places a call. No SSN, no license #, no registration, and only liability

Email to agents:

I have an unusual request for liability insurance and am hopeful that your Agency will be able to help me. It’s come to my attention that it is not in fact a requirement to be licensed in North Carolina simply for the use of public roads and highways. There are decades of established case law and historical precedents to support this, but it’s a topic that generates lots of controversy. Bringing it up often limits further discussion on the matter.

As a potential customer I’m not interested in bringing you outside your legal comfort zone. I am interested in finding a solution which would provide me with insurance while not putting yourself in a legal gray area. If you have no interest in this, then I would like to thank you for your time and wish you the best of luck.

Otherwise I have a few questions that I would like to discuss:

Is it possible to begin liability coverage before I have purchased a car? And add it to my policy after purchase? Will this be possible without the use of a driver’s license number? I am not interested in insuring the actual car. Will it be an issue that the machine is not registered as a motor vehicle? If all of this is possible what type of paperwork would be required?

Thank you for your time, I look forward to hearing from you.

License / Identification

Let’s be honest. Government licensing serves an important societal purpose. That is the standard ID. Which in NC you can’t even get without being completely a “part of the system”.

Title

My interest is in keeping the property away from the state and in my hands alone. So that no matter what happens I am the undisputed owner. I will always have recourse if it is stolen. It seems apparent to me and others that by registering your vehicle it becomes a ward of the state. And my intent is to purchase a vehicle like this. Which means it is my responsiblity to disentangle the vehicle from its status with the state.

The first hurdle is getting the title and researching any liens that are on it. Then it seems that the Certificate of Origin of Vehicle (COV), which appears to be a specific type of Bill of Lading, is very significant. Manufacturers Statement Of Origin?(MSO)

Disconnecting From The System

Theory

The ultimate power in this world comes from God. As his creation we have been gifted with his likeness in our physical and mental capacities, among others. All governments created by man are a fiction and artifice that cannot have the same weight as Natural Law. Our republics in America are unqiue in that they recognize individual sovereignty and that it is the power of the people from which all authority is derived. So in the case of “motor vehicles” in North Carolina:

people > Constitution > Executive Branch (Governor) > Department of Transportation / Division of Motor Vehicles > policy of DMV

Reciprocity Agreements as to Registration and Licensing.

ยง 20-4.1. Declaration of policy.

It is the policy of this State to promote and encourage the fullest possible use of its highway system by authorizing the making and execution of motor vehicle reciprocal registration agreements, arrangements and declarations with other states, provinces, territories and countries with respect to vehicles registered in this and such other states, provinces, territories and countries thus contributing to the economic and social development and growth of this State. (1961, c. 642, s. 1.)

Useful Forms

  1. MVR-46F NC DMV – AFFIDAVIT FOR REMOVAL OF REGISTRERED VEHICLE FROM VEHICLE REGISTRATION FILES
  2. MVR-18A NC DMV – License Plate Turn in Verification
  3. MVR-28 NC DMV – AFFIDAVIT OF FACTS SURROUNDING THE INCORRECT ASSIGNMENT OF A [MCO] OR A [COT]
    • Probably not useable. However the form would be a good starting place for creating a unique affidavit that is appropriate to the case.
